Can I sue an apartment building owner for negligent security for a rape that occurred?

If you are the unfortunate victim of rape in an apartment complex in which you are visiting or in which you live, the short answer is yes, you can pursue the apartment complex for liability and responsibility for what happened to you in the civil arena. In most cases, the assailants are never caught and attempting to pursue justice against the apartment complex for making it possible for this person to gain entry and access to you is sometimes the only redress that you can seek. The general rule in Florida, though, is that the apartment complex has an obligation to provide you with safe premises and to prevent crime that is reasonably foreseeable. If there’s a prior crime on the premises and if there were implements that should have been undertaken for your safety and the apartment complex failed to do so, the chances are you have a pretty good shot at making a successful claim against the complex.
